danielle johnson. the deputies found the body of her mother, 37-year-old ton hobbs last night. they believe aja is with a man that they want to question about her mother's death. here is his picture, lester hobbs. he is not aja's father. authorities say he is driving a 1992 white toyota paseo with oklahoma license plate number 577-bpw. they believe that he was headed toward oklahoma -- or to davenport, oklahoma. so please, please keep your eyes open if you're in that area. the father of former olympic skater nancy care began died and her brother is charged with assaulting him. the boston harold obtained a police report of that alleged assaultment daniel care began and his son mark were yelling and pushing back and forth until the eldercare i began fell over. it says that mark kerrigan put his hands around his father's neck thinking his dad was faking it when he fell. the "herald" reports that police

had to use pepper spray to subdue mark kerrigan. in just over an hour, casey anthony will be in a florida courtroom. the 23-year-old charged with first-degree murder in the death of her 2-year-old daughter okay lei caylee. today's hearing is related to check fraud charges. when police were searching for young caylee, anthony is accused of stealing hundreds of dollars from her friend to buy clothes and groceries and pay phone bill. caylee's remains were found in december of 2008. not clear what's going to happen at today's hearing. a trial on the fraud charges was supposed to have started to day. that was canceled. no trial date, no new one anyway, has been set. at least three dozen people were killed in more than 80 wounded in a series of car bombs in baghdad today. iraqi police say suicide bombers blew up three cars near a hotel popular with western journalists and businessmen. officials say they expect the death toll to rise.

police say at one of the hotels two men opened fire on guards before detonating the explosives. the first explosion was so strong it toppled a row of 10 foot concrete blast walls along the road. so far, no one's claimed responsibility. the attacks came shortly before state tv announced that chemical ali had been executed. the cousin of saddam hussein whose real name is ali hassan amajid. he was sentenced to death eight days ago for poison gas attacks that killed more than 5,000 kurds back in 1988. and lebanon's president says terrorism is not suspected in today's crash of an ethiopian airlines jet. it caught fire and went down minutes after taking off in beirut. 34 bodies have been recovered from the sea thus far. helicopters and naval ships have been searching for the other 56 people onboard. so far, no one's been found alive. pieces of the plane and debris

have been washing ashore, including passenger seats, a fire ex-continuitinguisher and f medicine. what will rebuilt haiti look like? a lot of people are wondering that. leaders from a dozen countries are meeting to talk about reconstructing the earthquake devastated country now. secretary of state hillary clinton is among the foreign ministers. families of americans still missing in port-au-prince rubble are really angry and frustrated that rescue efforts have been called off. they started a petition asking for rescuers to keep searching. in fact, the father of a missing college student just returned from haiti after seeing it all firsthand. >> i will never forget what i saw, what i smelled, and what i saw. our bret is still missing. we're not sure where she is. but we are preparing ourselves for the worst and praying for a

miracle. >> i can't imagine what those people are going through now. one reason those families are still holding out hope is this man. look at him. he was rescued saturday, 11 days after the earthquake. and you saw him, he had no signs of injuries. he was just badly dehydrated. members of the rescue team started crying when he came out. i'm sure they did. they explained on sister network cnn how he was able to survive. >> actually, after the rescue, we had a chance to get into the hole and have a look. and we found out that he had access to cookies, beer, and coke. >> how is that possible? >> the building was a grocery shop. and it was very lucky. he fell down on the food side of the grocery shop. >> isn't that just extraordinary? the haitian government now says the confirmed death toll is more than 111,000. you're looking at the

funeral for the catholic of the archbishop of port-au-prince. many of the victims are buried in mass graves like this one. european officials say another 250,000 people were hurt and the u.n. says more than 600,000 are homeless. 80 homes are threatened and some of them could slide down a hill. this is what's happening in san antonio. look at this. soil is sliding. it's cracking retakining walls. one couple says this happened just a week after the builder's warranty ran out on their house. a local fire chief says he wouldn't be surprised if houses start sliding today. i know. looks a little crazy, like mardi gr gras. no, that is still three weeks away. this is party time in new orleans. they're celebrating the saints going to their first super bowl.

they won the nfc championship with an overtime field goal to beat the minnesota vikings. there it is. the saints will face the new orleans natives in miami, though, indianapolis quarterback peyton manning. he led the colts to a two touchdown victory in the afc championship game. president obama is promising new assistance for families dealing with hard times. how he plans to help them.

joe biden chairs a task force on middle class. it is proposing to double the childcare tax credit and increase federal funding for childcare services.

it proposes increasing tax breaks for retirement savings and capping student loan payments. now the task force recommendations will be included in the president's budget for next year. but wednesday's state of the union address got us thinking. what do you want to hear from the president? many think health care reform is unsalvagable. they say the president should concentrate on creating jobs. this is "your views" topic today. richelle, people have already weighed in. on my facebook page, people are saying jobs, jobs, jobs. >> that's the response we've gotten so far. some people are saying he can do both. we're going to try to jump into this and give you a lot of different points of view. we're going to start with an e-mail.

>> we have a caller on the phone. you say that health care should still be the focus. >> caller: absolutely. i support continuing to work on that. i believe it will create a boat load of jobs. we're going to bring on 30 million more people. i listen to the debates with congress and read portions of the bill online. i've studied it for quite a while. and in the bill they're going to be investing in community clinics and medical schools. and, so, in order to cover, you know, 30 million more people, we need a lot more doctors, nurses, x-ray technicians, janitors even. >> i do see where you're going with this. but for some people, they might say, you know, i don't necessarily have an interest in being in the medical field.

and some people may say that's not soon enough. they may say, you know, i've been out of work for six months. they don't feel that's immediate enough. do you know what i'm saying? >> caller: but if you're out of work and can reengineer yourself in the medical field or if it's even a temporary job as a janitor, it is still going to bring into the community, in the private sector jobs, a whole bunch more jobs. i mean it will even span out from there. if a lot of people can get healthier, it will reduce the crime rate. there are a lot of people that are unemployed, depression sets in. a lot of bad behavior sets in. if you can send that off with health care and with jobs -- >> i hear where you're going. i can tell you've done a lot of home work on. this thank you for your passion. let's hop over to greg from california. greg, you're one of those people who is having a really tough time in this economy, aren't you? >> caller: yes. i'm a proud member of a local 12

a hearing is it set today to determine whether prosecutors can use here say evidence during peterson's trial. his former wife was found dead in her bathtub. officers exhumed her body and resumed the death a homicide after peterson's fourth wife, stacy, vanished in 2007. peterson's neighbor testified friday that he told her stacy ran off with another man but she didn't believe his story. peterson has not been charged in

stacy's disappearance. all right. you just saw the picture actor gary coleman was arrested in utah. the "salt lake tribune" reports that he is accused of suspicion much domestic assault. he was arrested after a disturbance was reported at his home and they found out he was wanted for failure to appear in court in a previous case. we have not heard, by the way, from coleman or his attorney yet. fascinating new video of police interrogations after that balloon boy incident. it shows ni umy heene confessing that the whole thing was a hoax. deputies say she admitted it after they told her she failed a lie detector test. they told richard heene the same thing. he never confessed. he did get agitated when interrogators refused to let him see his wife. >> i -- why can't you let me see her? >> i need to ask her about something. in an hour, casey anthony will be in a courtroom. she is charged with the death of her 2-year-old daughter caylee. today's hearing deals with unrelated check fraud charges. during the time in 2008 when police were searching for young caylee, anthony is accused of stealing hundreds of dollars from her friend to buy clothes and groceries and to pay her phone bill. caylee's remains were found in december 2008. it's not clear what's going to happen at today's hearing. a trial was supposed to start today. that was canceled and no new trial date was set. beth karas of "in session" has been following the casey anthony case. she joins us by phone.

so, beth, let us know what could happen today. is there talk of any plea deal in this case? >> today was supposed to be the start of the check fraud trial. the judge said this case is going to trial or it's going to be disposed off by plea on january 25th. it appears the attorneys haven't really done much in preparation for trial. that's why the talk is there is going to be a plea today. there may have been a deal reached where the prosecution will dismiss some charges as long as she pleads to others and takes a certain sentence. or she may throw herself at the mercy of the court which means she may have to plead to all 13 felony accounts and then hope the judge will give her a pretty light sentence. >> now, beth, what happens in court today? could it have any bearing on the pending murder trial? >> yes. it will in all likelihood have a bearing. it will be litigated down the road, i suspect. what evidence, what conduct related to the check fraud

charges will be admitted at the murder trial? i suspects the prosecution is going to strenuously argue it's intertwined with the evidence since this is her behavior during the time sher daughter was missing. there is a 30-day period for these check fraud charges. yes, it could have an effect. >> another effect i'm wondering, too, if she's convicted of check fraud, could that taint jurors in the murder trial? >> yes. it definitely could taint the jurors. but there is a lot of taint already according to the defense. that's why they've already moved for a change of venue. that has not been ruled on yet. it is a pending motion. they say this community and orlando which is where i am right now is just super saturated with media coverage of the case. so even up until now they say she can't get a fair trial. this will only make it worse from the defense point of view. >> got you. okay. beth karas with "in session." thank you so much. we appreciate your insight as always. right now we want to let you

know about a search in oklahoma. it's for a 7-year-old girl who may have been abducted after her mother was killed. an amber alert is issued for this little girl, aja danielle johnson. the deputies found the body of her mother, 37-year-old tonya hobbs last night inside her rv. police believe aja is with her mother's estranged husband. they want to question this man, take a look, 47-year-old lester hobbs, about the woman's death. we want to point out hobbs is not aja's biological father. authorities say he is driving a 1998 white toyota paseo with the oklahoma license plate number 577-bpw. they believe he was headed toward davenport, oklahoma. so please keep your eyes open in that regard. i want to let you know this week we're beginning a new series on hln highlighting the cases of children who vanished and we're enlisting your help in trying to find them. our first case isn't just a missing child. it's an entire missing family.

it has baffled authorities in oklahoma. madison jamieson was last seen about 3 1/2 months ago. there is her picture. she was with her parents october 8th when they all left their home. it was in eufaula. no one's seen any of them since. the truck they were driving was found 30 miles away two weeks later in a very rural area. kristen anderson is tracking that case. earlier i asked her about the discovery of the family dog that was still alive inside that vehicle. do authorities believe that the family abandoned the car intentionally? >> no. that's what makes this event so puzzling. obviously they wouldn't have left the dog in the car if they planned to be away from the car for very long. they had also left a number of personal belongings in the car in plain view which since it's in such a remote area, there was no reason to be concerned about theft. so they're not really ruling anything out including foul play at this point. >> now please take a look at these pictures.

a lot of analysts were expectsing disappointing home sales. they are not anticipating there to be this big of a dive. existing home sales sank 16.7% last month. a big reason -- federal tax credit of up to $8,000 for first time homeowner was originally supposed to expire in november. that deadline has been extended, though, now through april 30th.

the case and joining us now from florida. beth, thanks for your time. will she take a plea deal in the check fraud case? >> reporter: good afternoon, chuck. it is uncertain. today is supposed to be day one of her trial on the check fraud case. but the judge said it's going to trial or it's going to be disposed of by plea. it doesn't appear they're ready for trial. everyone is saying it's probably going to be a plea. the attorneys will not confirm it, but that's what we expect. >> surveillance video shows her at shopping malls spending some of this $700 that allegedly was from her friend, her friend's money. will that be allowed at her murder trial? because this occurred, apparently, while caylee was missing? >> reporter: it's a good question. i'm sure it's going to be litigated by the attorneys down the road in preparation for the murder case. but the prosecution is likely to say it is inextricably intertwined with the evidence of murder. it's during the time that her daughter was last seen until she was reported missing. this is her conduct when she says that she was worried about

her daughter, she was looking for her daughter. what was she doing? she was allegedly stealing her friend's money and buying things for herself. >> talk about the motion hearing today involving the murder case itself. the attorneys want to depose the wife of the meter reader who found caylee's remains. why do they want her testimony again? >> reporter: they're asking to preserve her testimony because she's very ill. in fact, she's terminally ill. too sick to travel and lives in tennessee. in the event she's unavailable, perhaps has passed on, perhaps to sick to come to a trial in florida whenever that trial starts in the fall or in the summer, they want to preserve it in advance where both sides will be present. in depositions usually just one side is asking the questions. here it would be like a direct and cross-examination at trial on videotape to be shown later. it's a good idea sometimes when you know someone is sick or may be unavailable to do this. it doesn't mean it will actually be played at trial. maybe it won't even be admissible. but the judge is supposed to take that motion up today. >> are they trying to create

secretary of state hillary clinton is among the foreign ministers. families of americans still missing in the port-au-prince rubble are angry and frustrated the rescue efforts have been called off or suspended. they've started a petition asking for rescuers to keep searching. the father of missing college student just returned from haiti after seeing all this firsthand. >> i will never forget what i saw. what i smelled, and what i saw. our brit is still missing. we're not sure where she is. but we are preparing ourselves for the worst. and praying for a miracle. >> the haitian government now says the confirmed death toll is more than 111,000. this is the funeral for the catholic arch bishop of port-au-prince who was killed in the quake. he was buried saturday. many of the victims are buried in mass graves like this one. european officials say another 250,000 people were injured. the u.n. says that more than 6,000 have been left homeless.

a reporter for the website "the daily beast" says he's gotten the inside scoop on the night tiger woods rammed his suv into a tree as word of a sex scandal broke. he says just before thanks giving, woods told his wife the "national enquirer" was reporting a story he had an affair with nightclub hostess rachel uchitel. woods had uchitel talk to his wife by phone to assure her the relationship was platonic. she wasn't convinced. woods reportedly took an am bean and went to bed. elin then checked woods' phone and found a text message to uchitel saying he loved her. he says his sources then tell him she sent text messages from

welcome back. president obama is previewing one of the themes he's going to raise during the wednesday state of the union address. he and the vice president offering some new government help for families caught in a financial squeeze. biden shares a task force on the middle class is proposing the government double the child care tax credit and increase fundsing for child care services, give new tax breaks for retirement savings and cap student loan payments. the task force recommendations to be included in the budget for the next fiscal year. the wednesday state of the union got us thinking, many think health care reform is unsalvageable and that the president should now concentrate

live pictures from orange county florida in orlando where casey anthony is due to appear at one of those witness tables very shortly. that's the 23-year-old charged with first degree murder in the death of her little girl, 2-year-old caylee anthony. this hearing deals with an unrelated check fraud charge during the time in '08 when police were searching for little caylee. anthony -- this is surveillance video -- is accused of stealing hundreds of dollars from her friend and then going out and buying clothes and groceries and paying her phone bill, all at the time her little girl was missing. caylee's remains were found in december of 2008. it's not clear what will happen at today's hearing. the trial on the fraud charge was supposed to begin today, canceled at the last minute with no new trial date set, setting

crude at port arthur when it collided with a tow boat this weekend. coast guard crews say about half the oil has either evaporated, dispersed r been collected. two nearby sensitive wildlife areas remain unaffected by the spill. dozens of homes in san antonio are in danger of collapsing because the soil seems to be shifting. it's like a giant sink hole. our affiliate is live in san antonio with the latest. simon, hi? >> reporter: hi there, chuck. at this point the city emergency management director says it looks like about five homes are in danger of collapse. some damage already to the homes in the form of cracks in the windows. and he says in one situation, there's a home that has a foundation, a gap big enough underneath that foundation for a man to stand under the foundation. engineers are calling this a slope failure and by homeowners' accounts it started happening sometime this weekend. by sunday morning the situation was so unstable the city ordered 80 houses to evacuate. the city's emergency management

count 11 is, again, the defendant unlawfully using the personal identification of the victim without her permission. count 12 involves the defendant falsely making or forging check number 146 with the intent to defraud. count 13 reflects the defendant actually passing the check in the amount of $250 at the bank of america. going back to count 1, judge, the state will be prepared to prove that the crime's already documented, constituted one scheme or course of conduct to obtain the victim's money with the intent to permanently -- temporarily or permanently deprive the victim of over $300 in cash. that's what the state will be prepared to show. >> such as for the factual basis, the defense will stipulate. >> ms. anthony, do you understand if the case had gone to trial, that's what the state would expect to prove against you? >> yes. >> all right. i find you to be alert and intelligent. the plea was freely and voluntarily entered into. there is a sufficient factual basis for my acceptance of the

a handful of new initiatives to help everyday americans. personal finance editor gerri willis breaks them down in today's >> hee are proposals on the table. child care assistance. the program would nearly double the tax credit for families learning less than $85,000. those earning up to $113,000 will see an increase in the program. two-thirds of families with children are headed by working parents or single working parent. it limits loan payments to 10% of discretionary income. the program is estimated to cost the government $400 million to $500 million over ten years and expands an existing program. and those trying to improve retirement security here, it would expand the saver's tax credits for folks earning $60,000 or less. it would make that refundable which means you would get the money whether or not you owed

stan strickland would withhold sentencing until after the murder trial because he doesn't want his client there, casey anthony, to go before that jury. let's listen in here. >> as to counts 5, 8 and 11, which are three of the four fraudulent use of personal identification counts, the court's going to withhold adjudication and sentence ms. anthony to time served, which, again, is 412 days, followed by one year of supervised probation, which is a little bit of a thorny issue based on what you've heard here today. i'm not normally in a habit of explaining a sentence to the public. we usually just rule and roll. but in this case, the -- you should know that we can't put somebody on probation unless there's a period of -- excuse me, we can't withhold adjudication unless there's a period of probation attached to it. so we don't know what the future holds here. if the state's correct, there will be a conviction and lengthy

prison sentence. or worse, if the defense is correct, there will be an acquittal and she will walk free. what i will do on those counts, i'm ordering probation and giving her a withhold, counts 5, 8 and 11, and three of the four fraudulent personal i.d. counts, there's going to be a withhold followed by a year of supervised probation once released. again, that's an issue here, with the following special conditions. first of all, no personal contact, direct or indirect, with the victim, plus payment of court costs, which madam clerk, i've forgotten, how much are court costs? $348. plus payment of the costs of investigation. the amount the state is requesting is $5,517.75. court's ordering payments of cost of the investigation if necessary. we could have a hearing on the reasonableness of that amount at

emotional testimony about the shooting death of a caps as doctor. these are live pictures coming to us right now. a church usher told a wichita jury he saw this man, scott roeder, walk up to dr. george tiller and put a gun to his head. tiller was also serving as an usher when he was shot to death. the witness testified the gunman threatened to shoot him, too, when he tried to block the exit. roeder claims he was justified in killing tiller to prevent the doctor from performing abortions. prosecutors contend it was cold-blooded execution. also, quite some testimony from a neighbor of former illinois police officer drew peterson. he's charged in the death of his third wife. sharon says peterson's fourth wife stacey told her she was

the latest on the missing girl in oklahoma. the 7-year-old has been missing for some time. here is the latest. >> body of 37-year-old tonya leann hobbes was found inside a camper inside the residence of geronimo. miss hobbes was the estranged wife of a man named lester william hobbes. mr. hobbes is 46 years of age,

6'1", and 190 pounds, a white male. the hobbes were going through the process as we understand it of a separation. at some point she was trying to reconcile it and she was down visiting lester hobbes at his camping trailing here. the trailer is on some family members of the hobbs family. the family became concerned yesterday when they didn't see tonya or her small daughter. her small daughter, 7-year-old aja, and i want to clarify her spelling of her name it's actually an unusual spelling. it's a-j-a. her middle name is danielle johnson. aja is a white female, 7 years of age as i previously stated. she's 4 foot tall, weighs about 59 pounds. she has brown hair, brown eyes, and her hair has a reddish tint

to it. i just got off the telephone with her real father just a few minutes ago, and he described her hair as having dark black tints that had recently been dyed. once the family noticed that they hadn't been around on sunday afternoon, they became concerned. one of the family members actually pried the door of the trailer open and found the body of tonya hobbs inside the residence. what's concerning us is lester hobbs is not present at this location nor is 7-year-old aja hobbs. there is no relationship between lester -- let me clarify that name. it's aja johnson. there is no relationship between them. we know they were driving at least a 1992 toyota paseo. the car has been described as white in color. it should have oklahoma license tag 577-bpw. that's boy paul william.

another thing that's kind of unusual about this car as the family describes it is the hubcaps are missing from the automobile and the rear passenger window has been broken out and has some plastic taped up around it to stop the elements. as i said, we've been on the investigation since late last night. this is a joint effort among multilaw enforcement agencies in the area. our primary focus, number one, so to find aja johnson and for her safe return. the only thing that's really developed in the investigation since i spoke to many of you earlier this morning is the fact that today in lincoln county, oklahoma, lester hobbs was supposed to appear at 9:30 in district court on a dui charge. he did not appear. as a result of his failure to appear, lincoln county has issued a felony warrant for his arrest for failure to appear on that dui charge.

this is just another element in the arsenal that law enforcement is utilizing at this point in time to see if we can locate him and at least find him, detain him, and see what we can determine, what the status of aja might be. i'll take just a couple of questions on it. there's not much we're going to be able to really divulge at this point in time. this is an ongoing process and -- we'll give you maybe three or four here. any questions? a prosecution witness described the moment a kansas doctor was gunned down inside a church in wichita and i.d.'d the man charged with murder. jean casarez joins from just outside. several eyewitnesses or at least two eyewitnesses. >> these are the star witnesses for the prosecution case. the first up with to take the stand was gary. he testified he was talking with dr. george tiller in the foyer of the church. both of them were ushers that sunday morning. all of a sudden he saw the man come out of the sanctuary. he looked down and then looked up and he saw a small caliber gun at the temple of dr. george tiller. the trigger was pulled, he said. he saw it all with his own eyes

and dr. george tiller lay flat on his back after that. the other witness, keith martin, said he was in the foyer, all of a sudden he heard a sound, he turned. he saw scott roeder, who the defense admits did the shooting, run out of the church foyer and to his car. both of them testified that scott roeder turned the gun on them saying, move or i'll shoot you. and that is important because there are two charges of aggravated assault saying that scott roeder put them in visible harm and apprehension of fear for their life. >> it's also important in the sense that he claims, roeder claims, that he was sort of seized by this impulse to protect unborn children, and yet he didn't just drop the gun. he tried to get away. in fact, he allegedly pointed the gun at the people who were trying to stop him from fleeing, right? >>. >> reporter: you're right, and all of this goes toward the intentional premeditation that the prosecution is asserting in this first-degree murder case,

but, chuck, i have to tell you, they're on cross-examination right now, and the defense attorney is bringing out all of the different episodes of violence, quote, unquote, that were perpetrated on this church because dr. george tiller was a member. for instance, back in 1996 he said somebody ran in the church and tried to push the piano player off of her bench. there have been continued protests throughout the year. i think what the defense is going to try to show is that the state of mind of the defendant, that he never did this violence through the years, he sat quietly at that church, visiting it several times before the murder and it was his honest belief that because had church had the member of george tiller in their congregation, that he had to fek effectuate violence. >> are tiller and other family members present? >> yes, they are in the courtroom. you know, chuck, let me tell you what i did during lunch. i want to meet people and see who is here. i was on the ninth floor where

it limits loan payments to 10% of discretionary income. now, the program is estimated to cost the government $400 million to $500 million over ten years and it expands an existing program called the income-based repayment plan. also something for people who are saving for retirement trying to improve retirement security here. it would expand the savers tax credit matching 50% of the first $1,000 of contributions for folks earning $65,000 or less. and it would also make that refundable which means you would get the money whether or not you owed north carolina tax owed income taxes. it also improves disclosure of 401(k) fees and if you're responsible for taking care of your parents, there's an elder care assistance program increasing funding for caregiver support programs, adult daycare, and in-home home services. we spent the morning talking to personal finance experts from tax specialists to retirement specialists. they say these programs are highly targeted for people who

president obama's previewing one of the themes he'll raise at his state of the union address wednesday. he and vpd biden are offering new government help for families caught in this kmnl squeeze. biden chairs a task force on the middle class and it's proposing the government double the child care tax credit, increase funding for child care services give new tax breaks for resirmt savings and cap student loan payments. the task force recommendations will be included in the president's budget for next year. what are your questions of the day been? do you think the president should maybe stop focusing on health care as much and focus more on the economy and jobs? let's hop on the phones and talk to some people. first caller is al from california.

al, it was tough for you to decide which was more important, health care or jobs and the economy. when do you think it is? >> caller: i really do believe that the most important part right now is the health care reform. the reason being, it's like putting water in a bucket way hole. you can have the economy stimulated, but if the -- if there's no cap, no guidelines on the health care, the health care will constantly climb and now you're going to see, say, for instance, the average person making $55,000 a year, and most of those medical bills is just going to take that out. let's first fix the bucket. fix the hole in the bucket, and then we can start maybe working on the economy, because that money will be -- >> let me ask you this, al. some people say i don't have a bucket, because my bucket would be a job, and i don't even have that. i hear what you're saying. i'm telling you other feedback we've been getting today. people saying, i don't even have a problem with working on health
